EL PASO, Texas (KFOX14/CBS4) — A 20-year-old aunt in El Paso was arrested after her one-year-old nephew grabbed her “weed” vape and became intoxicated.
On May 22, Deputies with the El Paso County Sheriff’s Office arrested Vianney Alyssa Acosta and charged her with drug possession and endangerment of a child after her one-year-old nephew appeared to have inhaled smoke from her THC vape.

According to the arrest affidavit, on May 16, deputies responded to the 13200 block of Walker Post Avenue in Far East El Paso County after receiving a call of a one-year-old having trouble breathing.
In the arrest affidavit, deputies described the one-year-old as appearing lethargic and having glassy eyes.
The deputies then reportedly spoke with relatives of the child, who said they were taking care of the child while his mother was at work, when they heard the child coughing, and the grandmother saw him with the THC vape in his little hands.
Deputies then spoke with Acosta, who reportedly admitted that the THC vape was hers, but said she thought it was empty, not charged, and out of reach from the child.
According to the arrest affidavit, the child’s father was also home when the incident happened. He was reportedly working on a car outside, unaware of what had happened until deputies arrived at the home.
When speaking with deputies, the father said that the grandmother and the aunt were supposed to be watching the child.
The one-year-old child was taken to a local hospital, where, after a urine test, authorities confirmed the child had THC in his system.
It is unclear if anyone else watching the child is facing charges for this incident.

Jail records show Acosta’s total bond for both charges was set at $6,000 and that she was released the same day she was arrested.
