LINCOLN, Neb. (KOLN) – The crusade against vape shops across the state continues as Attorney General Mike Hilgers announced on Wednesday his office sent cease and desist letters to 82 Lincoln vape shops.
The AG’s Office says the locations are selling illegal THC-containing products.
So far, Hilgers has sent cease and desist letters to 204 stores alleging violations of the Consumer Protection Act (unfairness and deception), Uniform Deceptive Trade Practices Act and Nebraska Pure Food Act.
Earlier this year, the Lancaster County Sheriff’s Office and the AG’s Office purchased products from stores owned by 39 different companies.
Hilgers’ office said every store investigated had at least one product marketed as hemp but had a Delta-9 concentration over the legal limit, making it marijuana.
His office said over 90% of products had labels that incorrectly identified the contents.
“Our office’s testing showed that nearly every one of these products were mislabeled. This industry has shown itself to be completely irresponsible. It operates without regard to the health or safety of Nebraskans by selling these poisonous and mislabeled products into the Capital City,” Hilgers said.
The letters sent to the stores in Lincoln said many of the products sold misrepresent the concentrations of THC contained within them.
The AG’s Office said, with many of the stores also having a tobacco license, the sale of synthetic THC may put their tobacco license at risk.
Hilgers wants each of the stores to stop all sales of THC-containing products to Nebraska consumers to avoid litigation.
The office is demanding that each store return a signed document saying they will comply. If they don’t return the signed document, the AG’s Office will initiate litigation.
